Man shot by police in Willmar to stand trial December 26th

The Willmar man shot by police last year after he allegedly pointed at gun at them appeared for a pre-trial hearing in Kandiyohi County District Court this week.

Matthew Smith, age 47, is charged with two counts of 2nd Degree Assault with Fear and Threats of Violence. Smith was shot three times July 23rd 2017 by two Willmar police officers who had responded to a report of a suicidal male with a gun and encountered Smith in his backyard, sitting in a lawnchair and holding a handgun. He was shot three times by Willmar Police Officers Anthony Haycraft and Marco Vazquez when he refused to drop his gun and reportedly pointed it at them.

At the time, Smith’s blood alcohol content at the time was measured at .27, more than three times the legal limit for driving. He continues to recover from his wounds.

In court Tuesday Smith consented appearing in court via interactive TV and a list of defense witnesses was submitted. His jury trial is slated to begin December 26th.
