Plea in case of toddlers death in Olivia



Sergio Turrubiates Jr. entered a guilty plea in Renville County District court on Tuesday for an amended charge of 2nd degree murder without intent.
 
The 21 year old is being charged with the death of 19 month old Tiana Moore in December 2010.
 
Turrubiates was taking care of the child in Olivia when she suffered multiple blunt force trauma injuries to her head. She passed away on Christmas Eve 2010 at the Children’s Hospital in St. Paul.
 

Under the plea agreement-the original charge of 2nd degree murder is being dismissed.
 
A judge will sentence Turrubiates and determine if there are aggravated factors in the crime that would allow for an upward departure in the sentencing. He could face up to 240 month in prison.
 
The pathologist said the impacts indicated a “significant amount of force” was involved. There was evidence of injuries to Tiana Moore’s retinas and optic nerves consistent with those seen when children are shaken, according to testimony.
