Huber still needs time to hire attorney



More time is needed to hire an attorney.
 
81 year old Delbert Huber appeared again in Kandiyohi County Court yesterday and again the court action was delayed. This time until April 12th.
 
Huber of rural Paynesville is accused of murder along with his son Timothy age 45.
 
Huber explained to the judge that he was not prepared to represent himself and he should have an attorney by the next date.
 
Delbert Huber has appeared in court 7 times without an attorney. The proscecuting-county attorney objected to the delay commenting that there has been no progress in 4 months.
 
Huber’s application for a public defender has been denied twice by 2 different judges due to land ownership.
 
The judge gave warning to Huber that he would not be allowed to delay the case any further.
 
Family members have transferred land ownership in an attempt to get a loan against it to hire him an attorney.
 
A local attorney has been hired as an emergency conservator for Huber. The attorney requested for the best interest of justice that Huber be allowed the additional time to hire legal counsel.
 
An evaluation of Huber’s mental capacity was also ordered on December 7th.
