Hubers appear in court



The father and son from rural Paynesville accused of murdering Timothy Richard Larson, 43, of Albertville, both appeared in court Monday, but action was delayed in the father’s case pending his securing an attorney.

Delbert Huber, 81, was pushed into the courtroom in a wheelchair by a county corrections officer according to the West Central Tribune for his initial appearance before Kandiyohi County District Court.

Huber told the judge that he had been in contact with a local attorney, but that the attorney had advised him that he needed more time.

Delbert Huber is now scheduled to appear on Monday.

He faces a second-degree murder charge in the case. He was arrested after the Oct. 8 shooting and is held on $5 million bail in the Kandiyohi County Jail.

Huber’s son, Timothy Huber, appeared Monday with his court-appointed public defender. In addition to the procedural matters, an omnibus hearing was set for Dec. 16 in his case. The omnibus hearing is a pretrial hearing to consider what evidence will be admissible at trial and other related matters.Timothy Huber faces a second-degree murder charge, plus a felony for aiding an offender by serving as an accomplice after the fact. He is held on $1 million bail in the county jail.

According to court records, Delbert Huber is accused of shooting Larson with a 303 British Enfield rifle during a confrontation Oct. 8 over the fact that Larson ordered the Hubers and their farm equipment off farm property owned by Larson’s father. Larson was unarmed and was allegedly shot by Delbert Huber while Timothy Huber fed the cattle and chickens at Norman Larson’s farm.

According to the complaints against them, the Hubers left Larson’s body at the farm along 44th Street Northeast and did not report the killing to law enforcement until more than 12 hours later.
